NOTICE

PUBLIC NOTICE OF A DRAFT HAZARDOUS WASTE FACILITY LICENSE AND OPTIONAL PUBLIC HEARING RELATIVE THERETO PURSUANT TO MASSACHUSETTS GENERAL LAW CHAPTER 21C AND MASSACHUSETTS HAZARDOUS WASTE REGULATIONS, 310 CMR 30.000.

PUBLIC NOTICE OF PROPOSED REMEDIAL ACTION PLAN IN ACCORDANCE WITH THE HAZARDOUS WASTE REGULATIONS 310 CMR 30.000 AND THE HAZARDOUS AND SOLID WASTE AMENDMENTS (HSWA) OF THE RESOURCE CONSERVATION AND RECOVERY ACT (RCRA).

PROPOSED:

Solutia, Inc. is an existing on-site hazardous waste storage facility (Facility) operating under the terms of a Hazardous Waste License #36B/02 issued by the Department of Environmental Protection (MassDEP) on July 29, 2002. The company proposes to continue its operation and has applied for a five-year license from MassDEP.

A Draft License has been issued by MassDEP. Pursuant to the public participation requirements in 310 CMR 30.800, the public has forty-five days to comment on the Draft License.

A proposed Phase III Remedial Action Plan (RAP), dated January 2008, has been submitted to both the US Environmental Protection Agency (USEPA) and MassDEP by Solutia, Inc. for its Facility located at 730 Worcester St., Springfield, Massachusetts. The Facility is regulated under the Massachusetts Hazardous Waste Regulations 310 CMR 30.000 and the Massachusetts Contingency Plan (MCP), 310 CMR 40.0000. Massachusetts is authorized by the USEPA to implement the Resource Conservation and Recovery Act (RCRA) Corrective Action Program. Pursuant to the public participation requirements in 310 CMR 30.800, the public has forty-five days to comment on the proposed RAP.

PUBLIC COMMENT:

Any member of the public wishing to comment on the Draft License may file written comments during the public comment period that will extend from July 4, 2008, to August 17, 2008. Comments should be submitted to:

Any member of the public wishing to comment on the Phase III Remedial Action Plan may file written comments during the public comment period that will extend from July 4, 2008 to August 17, 2008. Comments should be submitted to:

Pursuant to 310 CMR 30.837(1), if during the comment period or within 15 days of the close of the comment period MassDEP receives written notice requesting a public hearing or if MassDEP determines on its own that there is significant public interest in either the Draft License or the Phase III RAP, MassDEP will schedule an informal public hearing on the proposed action. Written and oral comments will be accepted at the hearing.

The Draft License and a Fact Sheet that describes the licensing process, the company, its operation, and terms and conditions of the Draft License is available for review at the Springfield Board of Health, the Springfield Public Library, MassDEP’s Springfield and Boston Offices and the USEPA New England - Region I Office in Boston. Anyone wishing to examine the Draft License may do so at these locations. FINAL DECISION:

The MassDEP will consider all written comments received during the comment period; all comments received at a hearing, if held; and the requirements of the Massachusetts Hazardous Waste Regulations, 310 CMR 30.000. The MassDEP will then make a final decision regarding the proposed RAP and the issuance of a hazardous waste license to Solutia, Inc. A notice of the final RAP and license decisions will be sent to the applicant and to each person who has submitted written comments, or has otherwise requested notice of the final RAP and/or license decisions. If no comments requesting a change in the RAP or the Draft License are received, a final decision will become effective twenty-one (21) days after the date of the notice of the decision. The final RAP and/or license decisions will be postponed if a request for an adjudicatory hearing before the MassDEP is made within the twenty-one (21) day period.
