Guardianship Petition

 

 

SEE G.L. c.201, Sections 6,6A and 6B;

Probate Court Rule 29B; and Uniform Probate Practice XXII and XXII (A).

A Medical Certificate (CJ-P112)  form | instructions  must be filed in accordance with Uniform Probate Practice XXII.

For Guardianship of Mentally Retarded ONLY, a Clinical Team Report

(CJ-P118) is to be filed with this petition.  SEE G.L. c.201, Section 6A and Uniform Probate Court Practice XXII (A).

An Affidavit for Temporary Guardianship (CJ-P113)

should be filed with this petition.

A bond must be furnished.

SEE Uniform Fee Schedule for applicable filing fees. 

If certified that the ward's estate is less than $100.00, no filing fee is required. 

If the proposed ward's estate is $100.00 or more, a $150.00 filing fee,

a $50.00 bond and a $15.00 surcharge must be paid upon filing.
