An applicant may request reviews to both the Human Resources Division and to the Civil Service Commission (specific timeframes and conditions apply).

Under Massachusetts General Law, Chapter 31, Section 22, the applicant may make a request to the Human Resources Division to undertake one or more of the following:

  • A review of the marking of the applicant's answers to essay and multiple choice questions on a civil service examination
  • A review of the marking of the applicant's training and experience.
  • A review of a finding that he or she did not meet the entrance requirements for the examination. (The Personnel Administrator may deny this request in the case of a competitive examination for original appointment, if, at the time of the request, the administrator is currently accepting applications for a subsequent examination of the same type for the same position.)

The applicant has seventeen (17) calendar days after the mailing or the hand delivery of his or her examination results or his or her failure to meet the minimum entrance requirements for the position to request this type of review.

The applicant can also request a review of whether the examination was a fair test of the applicant's fitness to perform the primary or dominant duties of the position. This request must be filed within seven (7) days after the date of the examination.

Under Massachusetts General Law, Chapter 31, Section 24, and the Personnel Administration Rules, PAR .02 and PAR .08 (PARs) an applicant may appeal to the Civil Service Commission regarding the following:

  • A finding made by the Personnel Administrator that the applicant did not meet the entrance requirements for appointment to a position.
  • A finding made by the Personnel Administrator that the examination taken by the applicant was a fair test of the applicant's fitness to actually perform the primary or dominant duties of the position for which the examination was held.
  • A finding by the Personnel Administrator that relative to the marking of the applicants answers to essay questions.

The applicant has seventeen (17) days after the mailing of the Personnel Administrator's decision to file an appeal with the Civil Service Commission.

In addition, the applicant may also appeal a finding by the Human Resources Division that supports an Appointing Authority's decision for reasons for bypassing the applicant or selecting another candidate (non-appointment after the interview). The applicant has sixty (60) days to appeal to the Civil Service Commission.

You will be mailed a copy of your original answer sheet and the response key for the test so you can verify scoring of your answer sheet. Please note that this statute does not provide for the review of the test questions nor can multiple choice questions or the marking of multiple choice exams be appealed.

Filing Appeals with the Civil Service Commission

( M.G.L., Chapter 31, section 2 (b))

An individual or Civil Service employee may appeal his or her non-selection for an entry-level or a promotional Civil Service position. If an individual appeals a determination made by the Human Resources Division (HRD) regarding information provided by the Appointing Authority, the individual should submit a written request to the Civil Service Commission for a hearing and complete a Bypass Appeal Form pdf format of Bypass Appeal Form
. The Civil Service Commission will contact the individual and the community to appear for the hearing date. Please note that the appointment process is not delayed due to an upcoming Civil Service Commission hearing. The individual and community will be notified of the results of the hearing.
